Q: how do i form an LLC "side by side catering" business.  I am a caterer who will sell prepared food and homemade drinks to the public. I will buy my own food and prepare the meals myself and sell it throughout the state from my home/ food truck and future shop.
A: "side by side catering," first must be filed with an state LLC certificate.  Then a customized LLC operating agreement must be executed. Then, a federal tax id and a business license as well as a seller's permit must be obtained.

I am an interior designer that resides in PA and work from my home office - sole member LLC. I do not have a DBA name. I have my LLC formed in DE. The bulk of my work is in DE. I have a DE business license, FED EIN but am unsure if I need a DE wholesale license for reselling or should I be doing it in PA along with a PA business license?

Basically, an operating agreement outlines the rights and duties of the LLC members and sets their percentage of ownership.
